Terms and Conditions

I. Acceptance of Terms
By downloading, installing, or using Focuz, you expressly, unequivocally, and unconditionally accept these Terms and Conditions. If you disagree with any provision, you must immediately uninstall the application and refrain from using it.
II. Service Description
Focuz is an iOS mobile application designed to help you build and maintain positive habits through:
- Customizable habit tracking with streaks and statistics
- Virtual pet companion reflecting your consistency
- Intelligent reminders with motivational messages
- Pre-defined templates of popular habits
- Progress visualization via heatmaps
- Companion notes and quick reminders
- Zen mode with ambient sounds for relaxation
- Brain training games
- Home screen widgets
- iCloud synchronization across devices (optional)
- Customizable visual themes
Nature of service: Focuz is a personal productivity tool that works offline. Internet connection is only required for iCloud sync (if enabled) and in-app purchases.
III. Free and Premium Features
Focuz operates on a freemium model:
Free Features:
- Basic habit tracking functionality
- Virtual pet companion
- Local data storage
- Basic notifications
Premium Features (one-time purchase):
- Access to all app features
- All visual themes
- Advanced statistics and analytics
- Unlimited habits and customization
- Priority access to new features
Legacy Users: Users who installed Focuz before January 12, 2025 receive lifetime premium access at no cost as a thank you for early support.
IV. In-App Purchases
Premium access is available as a one-time, non-consumable purchase:
- Product: Focuz Premium
- Type: One-time purchase (non-subscription)
- Payment processor: Apple App Store (StoreKit 2)
- Family Sharing: Not available
Purchase Terms:
- Payment is charged to your Apple ID account at confirmation of purchase
- Purchase is tied to your Apple ID and can be restored on any device using that Apple ID
- Refunds are handled exclusively by Apple according to their refund policy
- We do not process payments directly and have no access to your payment information
Restore Purchases:
If you reinstall the app or switch devices, you can restore your purchase from the app's settings. This requires signing in with the same Apple ID used for the original purchase.
V. License to Use
You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to use Focuz only on iOS devices you own or control, exclusively for personal, non-commercial purposes.
Express prohibitions:
- Modify, decompile, or reverse engineer the application
- Copy, distribute, sell, or sublicense the application
- Remove or alter copyright notices or trademarks
- Use the application for illegal or unauthorized purposes
- Attempt to extract the app's source code
- Create derivative works based on Focuz
- Share your premium purchase with others (no family sharing)
VI. Intellectual Property
All rights, title, and interest in Focuz, including but not limited to:
- Source code and software architecture
- User interface design
- Graphics, animations, and visual elements (pets, icons, themes)
- Audio files and ambient sounds
- Texts, motivational messages, and editorial content
- Streak and statistics calculation algorithms
- “Focuz” trademark and related logos
Are the exclusive property of Juan Carlos Rivera Alvarado and are protected by intellectual property laws of Mexico, United States, and international treaties.
VII. iCloud Synchronization
Focuz offers optional iCloud synchronization:
- Control: iCloud sync is controlled by your iOS device settings, not by us
- Requirements: Active iCloud account with available storage
- Data synced: Habits, completions, pet data, notes, reminders, and settings
- Cross-device: Data syncs across all devices signed into the same Apple ID
- Responsibility: Apple is responsible for iCloud infrastructure and security
Important: We have no access to your iCloud data. Sync issues should be addressed through Apple Support or iOS Settings.
VIII. Data Storage and Loss
IMPORTANT WARNING:
If iCloud sync is DISABLED:
- All data is stored only on your device
- Uninstalling Focuz permanently deletes all data
- Device loss, damage, or reset results in data loss
- You are responsible for local backups via iTunes/Finder
If iCloud sync is ENABLED:
- Data syncs to your private iCloud storage
- Data persists after reinstallation if using same Apple ID
- Deletion in app syncs across all devices
- iCloud storage limits and availability affect sync
Recommendation: Enable iCloud sync to protect your data, and ensure you have sufficient iCloud storage available.
IX. Responsible Use
You agree to use Focuz responsibly:
- For legitimate purposes: Only to improve your personal habits
- Respect for others: Do not use the app for activities that affect others' rights
- Legal compliance: Comply with all applicable laws in your jurisdiction
- Good faith: Do not attempt to compromise the security or stability of the application
- No abuse: Do not attempt to circumvent premium features or manipulate purchase verification
X. Notifications
By enabling notifications, you authorize Focuz to send you local notifications (generated on your device, not from a server) to:
- Remind you to complete your habits at configured times
- Motivate you with personalized messages based on your current streak
- Alert you about your virtual pet's health status
- Remind you of quick reminders you've set
Notification characteristics:
- Completely local (no internet required)
- Can be disabled anytime from iOS Settings
- Messages vary based on your progress
- Quick actions available (Complete, Snooze)
- Maximum of 64 scheduled notifications at any time (iOS limit)
XI. Widgets
Focuz provides home screen widgets:
- Widgets display habit status and allow quick completion
- Data is shared between the main app and widgets via App Groups
- Widget updates depend on iOS system refresh policies
- Interactive widgets require iOS 17 or later
XII. Limitation of Warranties
Focuz is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including but not limited to:
- Results: We do not guarantee you will achieve your habit goals. Results depend exclusively on your effort and consistency
- Availability: Although the app works offline, iOS updates or iCloud issues could temporarily affect functionality
- Accuracy: Statistics and calculations are as accurate as possible but may contain errors
- Compatibility: The app requires iOS 17 or higher. Future iOS versions might require updates
- iCloud: We do not guarantee iCloud sync availability or reliability, as it depends on Apple's infrastructure
We are not professional advisors: Focuz is a productivity tool, not a substitute for medical, psychological, nutritional, or professional advice. For health-related goals, consult a specialist.
XIII. Limitation of Liability
To the maximum extent permitted by applicable law, Juan Carlos Rivera Alvarado and Focuz SHALL NOT be liable for:
- Data loss due to uninstallation, device failure, iCloud issues, or iOS update
- iCloud synchronization failures or conflicts
- Indirect, incidental, special, or consequential damages
- Loss of profits, productivity, or time
- Misuse of the application by unsupervised minors
- Decisions made based solely on app statistics
- Incompatibility with future iOS versions
- Issues arising from Apple's services (App Store, iCloud, StoreKit)
Maximum liability: In any case, our total liability shall not exceed the amount you paid for the premium purchase.
XIV. Minimum Age and Use by Minors
- Recommended minimum age: 4+ (App Store rating)
- Age verification not required since there is no account registration
- Parental responsibility: Parents or guardians are responsible for supervising minors' use of the app
- In-app purchases: Require parental approval if Family Sharing controls are enabled
- No inappropriate content: Focuz contains no violence, offensive language, or adult content
XV. Updates and Modifications
We reserve the right to:
- Update the application to fix bugs, improve functionality, or add features
- Modify these Terms and Conditions at any time
- Modify the pricing of premium features for new purchases
- Add, remove, or modify features in free or premium tiers
- Remove the application from the App Store for technical, legal, or commercial reasons
Change notification:
- Minor changes: Update of date in this document
- Significant changes affecting your rights: In-app notification requiring express acceptance
- Continued use after modifications: Constitutes tacit acceptance of new terms
Existing premium purchases are not affected by price changes.
XVI. Termination
On your part:
You can stop using Focuz at any time by simply uninstalling the application from your device. Your premium purchase can be restored if you reinstall using the same Apple ID.
On our part:
We may suspend or terminate your access to Focuz immediately, without prior notice, if:
- You violate these Terms and Conditions
- You attempt to reverse engineer or hack the application
- You use the app for illegal activities
- You distribute unauthorized copies of the application
- You attempt to fraudulently obtain premium features
Survival: Clauses regarding intellectual property, limitation of warranties, limitation of liability, and applicable law shall survive the termination of these Terms.
XVII. Third-Party Services
Focuz integrates with the following Apple services:
- ✓ Apple StoreKit 2: For processing in-app purchases
- ✓ Apple CloudKit: For iCloud synchronization (optional)
- ✓ Apple WidgetKit: For home screen widgets
Focuz does NOT use:
- ✕ RevenueCat or external subscription services
- ✕ Firebase or Google services
- ✕ Analytics services (Mixpanel, Amplitude, etc.)
- ✕ Crash reporting services (Crashlytics, Sentry, etc.)
- ✕ Advertising networks
- ✕ External AI services
XVIII. Indemnification
You agree to defend, indemnify, and hold harmless Juan Carlos Rivera Alvarado, its affiliates, directors, employees, agents, and licensors from any claim, liability, damage, loss, and expense (including reasonable legal fees) arising from:
- Your use or misuse of Focuz
- Your violation of these Terms and Conditions
- Your violation of third-party rights
- Fraudulent purchase attempts or chargebacks
XIX. Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable by a competent court, such provision shall be modified and interpreted to achieve the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
XX. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Mexican States, without giving effect to any principles of conflicts of law.
Jurisdiction: For any legal dispute related to Focuz, the parties expressly submit to the jurisdiction of the competent courts of León, Guanajuato, Mexico, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
Dispute resolution:
- Initial contact: Before initiating any legal action, attempt to resolve the dispute by contacting us at main@focuz.world
- Good faith negotiation: Both parties agree to negotiate in good faith for 30 days
- Legal action: Only after exhausting negotiation may legal action be initiated
XXI. Language
These Terms and Conditions are written in Spanish. Any translation to other languages is provided for convenience only. In case of conflict or inconsistency between versions in different languages, the Spanish version shall prevail.
XXII. Entire Agreement
These Terms and Conditions, together with the Privacy Notice, constitute the entire agreement between you and Juan Carlos Rivera Alvarado regarding the use of Focuz, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
XXIII. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Waiver of any provision of these Terms shall only be effective if made in writing and signed by an authorized representative.
